Overview
My client is an industry leader in providing alternative, affordable personal loans; they aim to give lines of credit to those who mainstream lenders have neglected. They are growing and adapting fast; with over 20 years of operation nationwide, they have helped hundreds of thousands of customers. The business has transformed from a traditional high–street lender to a multi–channel, online loan provider. They are regulated by the Financial Conduct Authority (FCA). They are now looking to hire a Director of Risk and Compliance to join the team. This is an excellent opportunity to join a thriving business during an exciting period of growth.
Purpose of the role
Reporting to the CEO, this position will ensure that the firm remains fully in compliance with all statutory and regulatory obligations through active management of all aspects of compliance, in addition to the development of responses to new regulatory environments and supervisory framework that impacts the firm s products, customers, operational environment and regulatory obligations to discharge.
Responsibilities
This role requires an individual to become an Approved Person for the SMF16 and SMF 17 with direct responsibility for all aspects, including the Compliance Oversight operation.
- To assist the business in meeting its regulatory obligation and provide regulatory advice regarding business propositions.
- To support Senior Management Functions (SMF) employees in meeting their regulatory obligations.
- To execute the MLRO function (SMF17), contributing professional experience and gravitas to the management of the firm s anti–money laundering procedures
- To promote the compliance and ethical culture promoting the understanding of FCA regulatory obligations.
- To provide in–depth advice on the Financial Conduct Authority (FCA) s rules and guidance as required in connection with the firm's regulated activities
- To review risk events, confirm rule references and advise, as required, on action to rectify any breaches of the FCA s Rules.
- To prepare a Compliance Monitoring Framework ensuring that appropriate monitoring of regulated activities is conducted and evidenced.
- To review and sign off monitoring reviews undertaken by compliance team members.
- To review audit findings, evaluate the business corrective action plans to deal with those issues and monitor progress in dealing with the problems.
- To act as custodian to keep records of all correspondences and regulatory reports with the FCA, FOS, and ICO as appropriate
Experience required
- Significant previous experience in a senior regulatory role, ideally an approved person by the FCA as SMF16/SMF17 (CF10/CF11)
- 10+ years of enterprise risk management, compliance or equivalent GRC program experience; financial services/fintech risk management experience preferred
- Detailed knowledge of the FCA Handbook, particularly SYSC, CONC, COCON, CDD, KYC, EDD and DISP rules and how they apply to the consumer credit environment
- Has experience presenting and reporting to Boards and Executive Leadership teams
- Ability to continuously prioritise projects based on risk or impact and confront conflict and complex issues professionally, assertively, and proactively
- Skilled negotiator with the ability to lead without direct authority, influence and build consensus across functional teams
- Excels with high levels of discretion, managing and communicating with staff at all organisational levels, from senior management to individual contributors
- Comfortable working in a fast–paced and innovative environment both with a degree of collaboration and autonomy
- Ability to analyse, present and report regulatory information to senior stakeholders in a clear and concise manner
Education
- Bachelor s degree or equivalent work experience in compliance, legal or other control–related function in the financial services firm, or legal/consulting firm
- Another advantage would be a diploma course by the International Compliance Association (ICA).
