Our client a healthcare company based in London is seeking a Contentious Legal Adviser on a permanent basis to ideally start December this year.
You will assist and support the Executive Director, Vice President of Legal Services and the Chief Legal Adviser in providing high quality legal services to the group.
The principal duties include:
*Having conduct of clinical negligence claims involving the Group, including drafting Letters of Response, attending Court hearings, and undertaking settlement negotiations where appropriate.
*Having conduct of inquests involving the Group's hospitals/clinics, including managing Coroner's enquiries.
*Managing matters relating to the General Medical Council, the Nursing and Midwifery Council, Care Quality Commission and/or any other regulator; preparing witnesses and attending regulatory disciplinary hearings in a support role for those witnesses.
*Investigating incidents relating to patients as well as concerns about clinicians, taking statements where necessary and preparing reports.
*Researching and preparing memoranda of advice / briefings and management reports in respect of risk assessment, liability, causation, quantum as well as regulatory and operational issues.
*Advising on and maintaining appropriate accruals as reserves for clinical negligence claims.
Other general duties include:
*Dealing with patient complaints, namely investigating and advising on the merits of complaints and drafting responses to patients.
*Corresponding with professional indemnity insurers and handling insurance claims.
*Providing advice in respect of all clinical governance issues, including advice on the withdrawal and suspension of clinicians' practising privileges, emerging trends in clinical incidents and other matters.
*Providing initial advice on employment law issues, as and when required, and escalating appropriately.
*Having conduct of personal injury and general litigation matters (including commercial litigation and debt recovery).
*Reviewing and advising on any contentious issues flowing from commercial arrangements.
*Advising on front line queries, such as copyright, data protection, debt, health and safety, financial, anti-bribery, anti-corruption, property and criminal issues.
*Reviewing proposed clinical and non-clinical policies and preparing new clinical and non-clinical policies (with appropriate input from clinical staff as required).
*Training nurses and other clinical staff as well as senior management on aspects of clinical negligence / personal injury / inquest litigation and regulatory issues.
*Any other duties related to the overall function of the Legal Department that may be reasonably required from time to time.
The successful candidate will have a minimum of 6 years PQE* from a healthcare background with a clinical negligence, inquests or regulatory practice.
You will have the ability to work under little supervision and be able to prioritise to work to tight deadlines. Excellent verbal and written communication along with excellent drafting skills is essential.
