Our market leading Newport Credit Hire team are part of the Claims Solutions Group, who deal with clients who are a mix of leading names in the insurance industry as well as household name corporates. They deal with all aspects of defendant credit hire dispute resolution, providing an end to end solution. Increasingly, the team is getting involved in pre-emptive advice on these issues and assisting clients formulate their own strategies.

The Credit Hire Team deals with both traditional and complex Credit Hire claims including General Terms of Agreement (GTA) and Non-GTA Credit Hire cases, enforceability, intervention strategies, illegality and intelligence/behavioural analysis.

The team has a progressive approach and a market leading reputation for not simply tackling the claims themselves from a litigation perspective, but also for tracking and analysing behaviours and trends with a view to providing insurers with bespoke strategies.


The Role

To provide a timely, professional and high-quality service to clients in the management of the high volume litigated credit hire cases.

As part of the fee earning aspect of this role, candidates are expected to:
• Handle a varied caseload of pre-litigated and litigated work covering the above types of claim with an appropriate level of supervision.
• Assume responsibility for quality control and benchmark compliance on own caseload, including accuracy and timeliness of management reporting and information.
• Ensure strict and ongoing adherence to benchmark standards in all work undertaken.
• To hit, maintain and apply a consistent approach to all individual targets of chargeable time, financial performance, realisation rates, settlement rates and average claim spend.
• Act as a point of contact for clients, demonstrating a level of knowledge and skill commensurate with experience.
• Exercise full compliance with DAC Beachcroft protocols on billing and credit control and demonstrate a high level of financial management in respect of own files.
• Aim to achieve a minimum budgeted annual target of 1440 chargeable hours per year.
• Support marketing and business development activity within the team e.g. attending marketing events and client training.
• Maintain an awareness of the firm's strategies and plans.

Our Claims Solutions Group advises insurers, self insured and corporate clients in their defence of claims relating to fatal accidents, catastrophic injuries, rehabilitation, employer liability, product liability, sports injuries, aviation injuries, occupational stress, repetitive strain, occupational cancers, new diseases, noise- induced hearing loss, safety, health and environment and severe road traffic accidents. The Role

Our large Newport team, whose clients are a mix of leading names in the insurance industry as well as household name corporates, deal with all aspects of defendant litigation, to include catastrophic injury, motor, casualty, disease, product and health and safety. Increasingly, the team is getting involved in pre-emptive advice on these issues as well as dispute resolution.

DAC Beachcroft LLP is the biggest defendant insurance litigation firm and is the top firm in the South West for defendant personal injury work (Chambers). DAC Beachcroft LLP has been involved in some of the leading cases that have been reported so the work is often high profile.

The Role

Reporting to the Team Partner and Associate, the ideal candidate will:

• Act as a first point of contact for designated clients.
• Maintain a case load of complex bodily injury claims with a value of up to £250,000.00, in strict adherence to the Service Level Agreement(s) entered into with the insurer client.
• Be responsible for managing all financial aspects of his/her caseload, to include billing in strict adherence to the Service Level Agreement(s) entered into with the insurer client, managing WIP, debt and resolving general accounting queries.
• Be responsible for the proactive and effective supervision of a team of fee earners handling cases valued up to £100,000.00, to include oversight of technical work, timely and accurate Management Information capture, and billing.
• Act as a technical point of reference for the Newport Motor team.
• Build relationships with client contacts at all levels where necessary.
• Day to day responsibilities will include but is not limited to the following:-
Analysis of evidence and setting case strategies encompassing both technical and commercial considerations, obtaining and drafting pleadings, witness statements and letters of response, conducting (telephone) negotiation of claims, preparing detailed counter schedules, sound file management – to include consistent and accurate: billing; management of WIP and file closures; updating Management Information.
• Participate in marketing and client training events where necessary.

The Person

Reporting to the Team Partner and Associate, the ideal candidate will have:

• Five or more years' experience of dealing with litigated bodily injury claims, with experience of handling complex physical and psychiatric injury claims, to include chronic pain.
• A defendant background/experience is preferable but not essential.
• The technical ability to appropriately advise insurer clients as to all issues associated with complex motor clams, including liability, multiple party claims, indemnity and complex issues of medical causation and quantum requiring close liaison with appropriate experts and counsel.
• Excellent communication and mentoring skills.
• A proven track record of working in a target driven commercial environment is essential.
• Excellent commercial awareness and an interest in broader business issues.
• This individual will be expected to be able to identify market trends, to provide commercially rounded advice to clients and view things from a business perspective.
• Flexible with an ability to adapt to rapid change, both internally and in the context of clients' businesses.
• Team player with a collegiate approach to knowledge sharing and problem solving, particular in the case of multi-site clients which are supported across the team.

ULR Litigator will profitably manage a caseload of uninsured loss claims acting at all times in the best interests of the Claimant.

The ideal candidate will be required to:

• To assist the Team Leader with the supervision, monitoring and development of the junior members of the ULR Team.

1. Case Handling

a. The Litigator will manage a workload of files, in accordance with the instructions of the Team Leader. The number of files will depend on the level of seniority, the complexity of the cases and the value thereof. This will consist of a balanced caseload of Small Track and Fast Track post litigation work.
b. Any claims that fall outside the Litigators individual authority level are to be reported to the Team Leader.
c. Litigators will comply with the firm's standard service levels and those that are applicable to particular accounts as a result of client preference.
d. Litigators will handle all cases in the best interests of the Claimant at all times. Any circumstances that prevent this or create a potential conflict are to be reported to the Team Leader and/or the Operations Manager.
e. Litigators will manage their files to ensure that all time spent is accurately recorded.
f. Litigators will manage their files to ensure that all payments made and received are accurately recorded and the procedures relating to payment of disbursements and damages are followed at all times.
g. Files will be maintained in accordance with the file maintenance procedures.
h. Filing will be kept up to date and in date order.
i. The Case Management system will be used properly and effectively in accordance with agreed procedures.
j. Any complaints to be reported immediately to the Team Leader and/or the Operations Manager.
k. Any mistakes or errors are to be reported immediately to the Team Leader.
l. All files in the Litigators system are to be reviewed once per month and a note made on the file (the cabinet review).
m. Litigators to monitor and manage own compliance with targets in respect of income and file closure rates.

2. Mentoring/Supervision

a. The Litigator will assist in the supervision and development of and management of the caseload handled by the ULR team litigators.
b. The Litigator will check and sign incoming and outgoing post received and produced by the ULR team litigators.
c. The Litigator will assist other case handlers within the ULR team with ad hoc queries
d. The Litigator to report to the Team Leader, any training requirements identified for each litigator as a result of the mentoring or review procedures.
e. The Litigator to assist in the training programme where required.


Minimum Specification

• Ideally with experience of RTA claims in either insurer or solicitor environment, credit hire experience preferable.
• In depth knowledge of liability and quantum issues and willingness to keep up to date with legal developments.
